Terms of Service
1. Acceptance of Terms
By creating a Drift account or using any Drift product or service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services. These terms constitute a legally binding agreement between you and VERIX Ltd.
2. Your Account
Account Creation
You must provide accurate information when creating your account and be at least 18 years old. Family members under 18 may use Drift under a parent or guardian's account. You are responsible for maintaining the security of your credentials.
Account Security
You are responsible for all activity that occurs under your account. If you believe your account has been compromised, notify us immediately at [email protected]. We will never ask for your passphrase.
Account Termination
You may close your account at any time from your account settings. We may suspend accounts that violate these terms, with notice where possible. In cases of illegal activity we may act immediately.
3. Subscription and Payment
Pricing
Drift is a paid subscription service. Founding members are entitled to their locked founding price for the lifetime of their account, regardless of future price changes.
Billing
Subscriptions are billed in advance on a monthly or annual basis. Payment is processed by Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis.
Refunds
If you are not satisfied within the first 30 days of your initial subscription, contact [email protected] for a full refund — no questions asked. After 30 days, refunds are assessed on a case-by-case basis.
Price Changes
We will give at least 60 days' notice before changing your subscription price. You may cancel before the new price takes effect. Founding members are exempt from any price increases.
4. Acceptable Use
You agree not to use Drift to:
- Store or transmit content that is illegal, harmful, abusive, or defamatory.
- Violate the intellectual property rights of others.
- Attempt to gain unauthorised access to any Drift system or account.
- Reverse-engineer any part of the Drift platform, except where permitted by law or our open-source licence terms.
- Facilitate spam, phishing, or other deceptive practices.
- Interfere with or disrupt the integrity or performance of the service.
- Resell or sublicence your Drift subscription without our written permission.
You are explicitly permitted to modify the firmware on your Drift device for personal use, run alternative operating systems, and repair your Drift hardware by any qualified technician. This does not void your hardware warranty for defects unrelated to the modification.
5. Your Content
You retain full ownership of all content in your Family Vault and all data you generate using Drift. We claim no rights over your content. Because your vault is encrypted with keys only you possess, you are solely responsible for ensuring your stored content complies with applicable laws.
6. Our Service
Availability
We aim to maintain 99.9% uptime. Planned maintenance will be announced at least 48 hours in advance. Status updates are published at status.drift-on.co.
Software Updates
We commit to providing software updates for all Drift devices for a minimum of 10 years from each device's launch date. Security updates will be delivered within 14 days of a verified vulnerability being identified.
Changes to the Service
We will give at least 30 days' notice before removing a feature you rely on, and will always provide a data export path before discontinuing any feature that stores your data.
7. Intellectual Property
The Drift name, logo, platform software, and associated intellectual property are owned by VERIX Ltd. Where Drift software is open source, it is licensed under the terms specified in the relevant repository.
8. Limitation of Liability
Drift's total liability to you for any claim shall not exceed the amount you paid to Drift in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages except where prohibited by law. Nothing in these terms limits our liability for death or personal injury caused by our negligence or fraud.
9. Governing Law
These terms are governed by the laws of England and Wales. Disputes are subject to the jurisdiction of the courts of England and Wales, except where consumer protection laws in your country give you the right to bring a claim locally.
10. Changes to These Terms
We will notify you by email at least 30 days before making material changes. If you do not accept updated terms, you may close your account and receive a pro-rata refund for any unused subscription period.
